PCH is where Huntington Beach’s most severe pedestrian cases happen. Beachgoers cross toward the sand, drivers watch the ocean instead of the road, and traffic moves at highway speeds through a corridor people treat like a beach street. Huntington State Beach alone runs two miles along it, from Beach Boulevard south to the Santa Ana River.

Vehicle Code section 21950(a) puts the burden on the driver: yield the right-of-way to a pedestrian crossing in a marked crosswalk, or in an unmarked crosswalk at an intersection.

The insurer’s standard reply is subsection (b), which preserves the pedestrian’s duty of ordinary care and bars stepping off a curb into the path of a car close enough to be an immediate hazard. Whether that actually happened is a question of evidence, not of assertion, and roadway markings and independent witnesses usually resolve it more reliably than either party’s recollection.

Cyclists on the coast route and inland arterials

Huntington Beach draws year-round bicycle traffic, and the conflict points are predictable: drivers overtaking too closely, and drivers turning across a bike’s path at driveways and intersections.

The Three Feet for Safety Act, Vehicle Code section 21760, governs the overtaking cases. A driver passing a bicycle moving in the same direction must do so at a safe distance that does not interfere with the bicycle’s safe operation, taking into account the size and speed of both and the surrounding traffic.

These claims frequently turn on physical measurements of the roadway rather than on testimony, which is a practical reason to document the location before conditions change.

Motorcycle crashes on the 405 and the coast

Motorcycle cases here split between the freeway and the coastal corridor, and in both the insurer tends to raise lane splitting immediately.

Vehicle Code section 21658.1 defines lane splitting as operating a two-wheeled motorcycle between rows of stopped or moving vehicles in the same lane, and it permits the CHP to issue educational guidelines. The section does not prohibit the practice.

That distinction gets misstated often enough that it is worth addressing directly and early, because an unchallenged assumption about fault tends to harden into the carrier’s settlement position.

Turning and driveway collisions on Beach Boulevard

Beach Boulevard is State Route 39, a wide multi-lane arterial lined with shopping centers, driveways, and left-turn pockets. The dominant crash patterns are broadside impacts from vehicles turning across traffic and rear-end collisions at signals.

The width that makes the corridor efficient for cars also lengthens the time a pedestrian is exposed while crossing. Cases here often come down to signal phasing, and that data has to be requested before it cycles out.

Summer visitor and rideshare traffic

Holiday weekends and the summer season concentrate a large volume of unfamiliar drivers into a small area, and rideshare activity rises with it.

When a rideshare vehicle is involved, coverage depends on the app’s status at impact. Public Utilities Code section 5433(b)(1) requires transportation network company insurance to be primary in the amount of $1,000,000 for death, personal injury, and property damage from the moment the driver accepts a ride request until the ride is complete.

Establishing that timeline is often the single most valuable step in the case.

Crashes involving a state highway condition

Both PCH and Beach Boulevard are Caltrans facilities. The City of Huntington Beach directs roadway maintenance issues on those routes to Caltrans rather than handling them itself.

That matters when a crash involves signal timing, signage, striping, or roadway design rather than only driver error, because the claim may run against a public entity. Government Code section 911.2(a) requires a claim for death or personal injury to be presented no later than six months after the cause of action accrues.

Six months is a short window, and it is the reason a possible roadway-condition case should be evaluated immediately rather than after the injury claim develops.

Hit-and-run and impaired driving

Vehicle Code section 20001(a) obligates a driver involved in a crash causing injury or death to stop immediately at the scene. Violations carry imprisonment, or up to one year in county jail, or a fine between $1,000 and $10,000, or both.

None of that pays your medical bills. When the driver is never identified, recovery usually runs through the uninsured motorist coverage on your own policy, which is why the declarations page is one of the first documents we ask to see.

Fatal collisions

Code of Civil Procedure section 377.60 determines who may bring a wrongful death claim, starting with the surviving spouse or domestic partner and children, or the decedent’s personal representative. The deadline is two years under Code of Civil Procedure section 335.1.

If a public entity may share responsibility, the six-month claim requirement applies alongside it. These cases move at the family’s pace, not ours.

It is wide, heavily signalized, and lined with commercial driveways. The San Diego Freeway (I-405)

Who maintains the road matters

Because PCH and Beach Boulevard are Caltrans facilities, the City directs maintenance issues on them to the State rather than resolving them locally. If a crash involves the condition of the roadway itself rather than only driver conduct, the responsible entity may be a public agency, and public entity claims run on far shorter deadlines than ordinary injury claims.
