Major arterials include Lakewood Boulevard, Firestone Boulevard, Florence Avenue, Paramount Boulevard, and Imperial Highway. The Downey Civic Center, Stonewood Center, and PIH Health Hospital generate steady local traffic on top of through-commute volume between the SE LA basin and the South Bay.

Yaghmai Law Firm represents Downey drivers, passengers, pedestrians, cyclists, and rideshare passengers on a contingency engagement. The firm investigates liability using Downey PD and CHP reports, coordinates medical care at PIH Health Downey and nearby facilities, and either negotiates with the carrier or files suit at the LASC Norwalk Courthouse. Downey Personal Injury Case Types

Most Downey injury matters fall along four corridors: the I-5 / I-605 interchange, the I-105 east terminus where it meets Studebaker Road and Lakewood Boulevard, the I-605 freight stretch carrying Port-of-Long-Beach traffic up through Pico Rivera, and the Lakewood / Firestone / Imperial arterial grid through Downtown Downey. The geometry of those corridors drives the case mix we handle.

  • Car accidents on the I-5 lane drops near Atlantic Avenue and the I-605 transition ramps, where southbound port traffic stacks into local commuters.
  • Rear-end collisions at the I-105 east end where traffic compresses into the surface-street merge at Studebaker Road and Imperial Highway.
  • Truck and big-rig crashes on the I-605 freight corridor between the Ports of Long Beach and the warehouse cluster off Imperial Highway.
  • Motorcycle accidents on Lakewood Boulevard and Firestone Boulevard, particularly at the Florence Avenue and Telegraph Road intersections.
  • Pedestrian and bicycle injuries on Imperial Highway, Brookshire Avenue, and the Rio Hondo bike path, where signal-timing gaps and missing crosswalks recur.
  • Rideshare (Uber and Lyft) accidents near the Stonewood Center, Downey Promenade, and Rancho Los Amigos pickup zones.

Crashes where the freeways meet Downey’s arterials

Downey sits inside a triangle of freeways, and the highest-energy collisions in the city tend to happen close to the ramps rather than out on the open freeway. Drivers leaving I-5, I-605, or I-105 carry freeway speed onto streets built for local commerce, and drivers heading the other way are focused on merging rather than on what is in front of them.

These cases usually hinge on speed and lane position at the moment of impact, which is why vehicle data and scene measurements matter more here than either driver’s later description of events.

Turning collisions along Firestone Boulevard

The City’s own mobility planning treats Firestone Boulevard as a primary arterial and the regional access corridor through Downey. It carries freeway-bound traffic past continuous retail frontage, which means a driveway or turn pocket every few hundred feet.

Broadside impacts from vehicles turning across traffic are the signature crash here. Liability frequently comes down to signal phase and right-of-way, and the useful evidence is often a nearby business camera rather than anything either driver recorded.

Pedestrians near the Lakewood Boulevard transit crossing

Lakewood Boulevard connects to the Metro C Line station serving Downey, so riders regularly cross a wide, fast arterial on foot to reach the platform. That exposure concentrates at commute hours and after dark.

Vehicle Code section 21950(a) requires drivers to yield to pedestrians crossing in a marked crosswalk or in an unmarked crosswalk at an intersection. Carriers reliably counter with subsection (b) and its requirement that pedestrians exercise ordinary care and not step suddenly into the path of a nearby vehicle.

That defense is a factual claim, and it is frequently contradicted by signal timing and by witnesses who saw the crossing begin on a walk phase.

Bicycle injuries on the commercial corridors

Riders sharing Firestone, Paramount, and Florence with heavy commercial traffic face two distinct risks: being passed too closely, and being cut off by a vehicle turning into a driveway.

The Three Feet for Safety Act, Vehicle Code section 21760, requires a driver overtaking a bicycle traveling the same direction to pass at a safe distance that does not interfere with the bicycle’s safe operation, given the size and speed of each and the traffic around them.

Roadway width and striping usually tell this story better than testimony does, and both can change with the next repaving.

Commercial truck and delivery-vehicle collisions

The I-5 and I-605 corridors move a heavy volume of freight, and Caltrans has run maintenance work on northbound I-605 between Firestone Boulevard and I-5 in Downey. Trucks reaching those ramps travel Downey’s arterials to get there.

A loaded commercial vehicle needs considerably more distance to stop than surrounding drivers anticipate. These cases also differ procedurally: the most valuable evidence, including vehicle data, driver logs, maintenance history, and dispatch records, is held by the carrier and governed by retention schedules that can erase it within months.

Preservation demands need to go out before the truck is repaired or put back in service.

Motorcycle collisions

When a motorcycle case involves lane splitting, the carrier tends to lead with it. Vehicle Code section 21658.1 defines lane splitting as riding a two-wheeled motorcycle between rows of stopped or moving vehicles in the same lane and authorizes the CHP to publish educational guidelines. It does not make the practice unlawful.

Correcting that early keeps an incorrect fault assumption from becoming the carrier’s fixed position.

Rideshare and app-based delivery collisions

Coverage in these cases depends entirely on what the driver’s app was doing when the crash occurred. Public Utilities Code section 5433(b)(1) requires transportation network company insurance to be primary and in the amount of $1,000,000 for death, personal injury, and property damage from the moment a driver accepts a ride request until the ride is complete.

Pinning down that timeline frequently changes a case from a minimum-limits claim into a substantial one.

Hit-and-run and impaired-driving crashes

Vehicle Code section 20001(a) requires any driver involved in a crash causing injury or death to stop immediately at the scene. A violation is punishable by imprisonment, or by up to a year in county jail, or by a fine of $1,000 to $10,000, or both.

A prosecution does not pay for your care, though. Where the driver is never found, recovery generally depends on uninsured motorist coverage under your own policy, so we ask for your declarations page early.

Dangerous property and dog-bite claims

Not every Downey injury involves a vehicle. Civil Code section 1714(a) sets the general standard: a person is responsible for injury caused to another by want of ordinary care in managing their property or person, reduced to the extent the injured person’s own want of ordinary care contributed.

Dog-bite claims are stricter and more favorable. Under Civil Code section 3342(a), an owner is liable for damages to someone bitten in a public place, or while lawfully on private property, regardless of the dog’s prior viciousness or the owner’s knowledge of it.

Claims involving a public entity

If a city, the county, a transit agency, or the State may share responsibility, a much shorter clock applies. Government Code section 911.2(a) requires a claim for death or personal injury to be presented no later than six months after the cause of action accrues.

That deadline should be identified in the first week, not discovered later.

Compensation in a Downey Personal Injury Case

Downey personal injury cases are filed at the Stanley Mosk Courthouse, 111 N. Hill Street in downtown Los Angeles. LA Superior Court routes all general-jurisdiction PI matters to its Central District Personal Injury Court under LASC Local Rule 2.3 and the standing order from the Civil Division (most recently revised during the 2023-2024 phaseout of the Spring Street PI Hub). The Norwalk Courthouse in the LASC Southeast District does not hear unlimited PI matters. From Downey that drive is roughly 12 miles up the I-5 or via the I-710 corridor; southeast LA jury panels historically skew working-class, which we factor into demand strategy.

Economic damages: medical expenses (Rancho Los Amigos National Rehabilitation Center, PIH Health Downey Hospital, and Kaiser Downey are the typical providers we see), lost wages, lost earning capacity, and property damage.

Non-economic damages: pain, suffering, emotional distress, and loss of enjoyment of life. Proposition 213 (Civil Code 3333.4) bars non-economic recovery for uninsured drivers and DUI plaintiffs.

Pure comparative fault under Li v. Yellow Cab Co. (1975) 13 Cal.3d 804 – an 80%-at-fault Downey claimant still recovers 20% of damages.

UM/UIM coverage under Insurance Code 11580.2 applies to uninsured and hit-and-run cases.

California Law That Governs Your Downey Case

None of these deadlines are negotiable.

  • Statute of limitations: two years (CCP 335.1); one year from discovery for medical malpractice (CCP 340.5).
  • Government claims: six months (Gov Code 911.2) against City of Downey, Downey PD, Downey USD, LA County, LA Metro, Caltrans, the State.
  • SR-1 reporting: CVC 16000 within ten days.
  • Hit-and-run: CVC 20001 and 20002.
  • Negligence per se: CVC violations under Evidence Code 669.
  • Comparative fault: Li v. Yellow Cab Co.
  • Proposition 213: Civil Code 3333.4.

Local Driving Routes and Hazards in Downey

Downey is bounded and crossed by three freeways, and nearly all of its regional traffic funnels onto a handful of commercial arterials. That pattern explains where injuries happen and which records will end up deciding the claim.

The I-5, I-605, and I-105 ramps

The freeway triangle around Downey delivers a steady stream of drivers onto local streets at speeds carried over from the highway. Caltrans has performed maintenance on northbound I-605 between Firestone Boulevard and I-5 in Downey, a stretch that illustrates how tightly the freeway and arterial systems are linked here. Merge-lane and rear-end collisions concentrate near these transitions, particularly in the evening peak.

Firestone Boulevard

The City identifies Firestone Boulevard as a primary arterial and the regional access corridor through Downey. It combines through-traffic with dense retail frontage, so drivers accelerating toward a ramp share the road with drivers braking to turn into a parking lot. Broadside and rear-end collisions dominate, and signal timing is often the decisive fact.

Lakewood Boulevard and the transit crossing

Lakewood Boulevard runs north-south and connects to the Metro C Line station serving Downey. Riders arriving on foot cross a wide, high-volume arterial to reach the platform, and that exposure peaks at commute hours and after dark when visibility is poorest. Pedestrian and left-turn collisions cluster at these last-block crossings rather than mid-corridor.

Imperial Highway, Paramount, and Florence

These arterials distribute traffic across the city and carry heavy school, medical, and commercial volume. Left-turn and signal-phase disputes are common, and fault usually rests on intersection camera footage or signal records rather than on the drivers’ competing accounts of who had the green.

Which agency holds your report

Collisions on Downey surface streets are investigated by the Downey Police Department, which maintains a dedicated traffic unit. Crashes on I-5, I-605, and I-105 fall to the California Highway Patrol. The distinction determines where the report lives and how it must be requested, and near the ramps two agencies can each hold part of the same crash.

What to Expect After a Downey Accident

Most people calling us have never brought an injury claim before. This is the practical shape of a Downey case and the places where avoidable damage tends to happen.

Deadlines are long, evidence is not

Code of Civil Procedure section 335.1 gives you two years for most injury claims. That is rarely what decides a case. Retail and residential cameras along Firestone, Lakewood, and Paramount overwrite on short cycles, commercial vehicle data sits on retention schedules, and witness memory fades quickly.

If a public entity may be responsible, the relevant deadline is six months rather than two years under Government Code section 911.2(a), which is a much easier thing to miss.

Confirm who investigated

Downey Police handle surface-street collisions; CHP handles the freeways. Requesting from the wrong agency costs weeks, and crashes near the ramps sometimes generate records in both places.

Treat the first offer as a starting point

Early offers arrive before the medical picture is understood, and accepting one generally ends the claim permanently, including for treatment still ahead of you. Injuries that seem manageable in the first week often look different once imaging is done.

There is no cost to having an offer looked at. If it is reasonable, we will say so rather than manufacture a dispute.

Recorded statements are optional

You are not required to give the other driver’s insurer a recorded statement, and those recordings are routinely mined later for language that narrows the claim. Obligations to your own insurer under your own policy are a separate matter.

Once we are retained, that contact routes through this office instead of to you.

Do not stop treating because of cost

Treatment gaps are one of the first things a carrier points to when arguing an injury was not significant. If cost is the barrier, that is worth addressing directly, and there are usually several options depending on your coverage.

How long it takes

A clear-liability claim with completed treatment can resolve within months. Disputed fault, continuing care, or a public entity claim lengthens that timeline. Settling before the medical picture stabilizes almost always means accepting less than the case is worth.

Why Downey Residents Choose Yaghmai Law Firm

Downey clients work with Yaghmai Law Firm because the firm is responsive, multilingual, runs on contingency, and operates entirely remotely. Houtan Yaghmai personally handles every case in English, French, and Persian, with Spanish interpreters available at no additional cost.

Downey clients usually reach out after trying to move a claim themselves and finding the process slower and more adversarial than they expected. This is a deliberately small practice. Houtan Yaghmai handles each matter personally from the first call through resolution, so nobody gets handed to a case manager and nobody has to re-explain their history at every check-in.

The firm operates remotely, which for a Downey client means no drive across the county, no parking, and no lost work hours sitting in a waiting room. Documents are signed electronically and updates arrive by phone or text around your treatment schedule and your job.

Conversations happen in English, French, or Persian, with Spanish interpreters arranged as needed. Injury matters are handled on contingency, so there is no fee unless there is a recovery, and the first call costs nothing whether or not you decide to hire the firm.

“By the time most Downey clients call, they have already gone a few rounds with the insurance company on their own. That is fine. We start from there.”

Downey Personal Injury FAQ

How long do I have to file a personal injury claim in Downey?

Two years from the date of the incident under CCP 335.1. If the at-fault party is a public entity (the City of Downey, Los Angeles County, LA Metro, or Caltrans for the state freeways like I-5, I-105, and I-605), you must first file a written claim with that entity within six months under Government Code 911.2 before you can sue. That six-month deadline trips up Downey claimants more often than the two-year statute does.

Where would my Downey case be filed?

The Stanley Mosk Courthouse at 111 N. Hill Street in downtown Los Angeles. LA Superior Court routes all general-jurisdiction PI matters to its Central District Personal Injury Court. The LASC Norwalk Courthouse in the Southeast District handles other civil matters but not unlimited PI.

Do you handle crashes on the I-5, I-105, and I-605 in Downey?

Yes. Those three interstates carry most of Downey’s catastrophic-injury volume. CHP collision reports from those corridors are the first records we pull, along with Caltrans signal-timing data and any tolling or transit-camera footage along the Imperial Highway and Florence Avenue interchanges.

What if the other driver was uninsured?

Insurance Code 11580.2 requires every California auto policy to offer UM/UIM coverage. If you carry it, we open a UM/UIM claim against your own insurer. Hit-and-run incidents are treated the same way.

What if I was partly at fault?

California is a pure comparative fault state under Li v. Yellow Cab Co. You still recover, but your share is reduced by your percentage of fault. There is no 50% bar.

Do I really pay nothing if you don’t win?

Correct. The representation is on a contingency fee. No recovery means no attorney fee and no cost reimbursement comes out of your pocket.

How much is my Downey case worth?

Case value tracks liability clarity, the severity and permanence of your injuries, your medical specials, lost-wage and earning-capacity loss, and the insurance coverage available. We share a candid range after we have reviewed the records, not before.

Will I have to go to court?

Most personal injury cases settle before trial, often at mediation. We file suit when we need to, and we are equipped to try the case if the insurer’s offer does not reflect what the case is worth.
