  • Pedestrian and bicycle strikes at Chino signalized intersections. CVC 21950 imposes a duty on drivers to yield to pedestrians within a marked or unmarked crosswalk at any intersection. Rideshare crashes in Chino: Uber, Lyft, and the three insurance periods

Chino riders and drivers rely on Uber and Lyft along the SR-71 Chino Valley Freeway, the SR-60 corridor, and surface routes such as Central Avenue, Grand Avenue, and Chino Hills Parkway, and a rideshare crash here is governed by a coverage scheme most drivers never see until they need it. California’s Public Utilities Code sections 5430 through 5442 split a rideshare trip into periods. From the moment a driver accepts your ride until the trip ends, Public Utilities Code section 5433(b) requires a primary one-million-dollar policy for death, injury, and property damage, plus sixty-thousand-dollar per-person and three-hundred-thousand-dollar per-incident uninsured and underinsured motorist coverage while a passenger is in the vehicle. When the app is on but no ride has been accepted, section 5433(c) drops the floor to fifty thousand dollars per person, one hundred thousand dollars per incident, and thirty thousand dollars for property damage, backed by two hundred thousand dollars in excess coverage. Section 5433(d) makes that coverage independent of the driver’s personal policy, which does not have to deny the claim first. Which period the Chino crash falls in decides which policy pays, and pinning that down is the first thing we do.

DUI and hit-and-run crashes in Chino

A drunk-driving or hit-and-run crash on SR-71, Riverside Drive, or a Chino arterial creates a criminal case and a separate civil case, and your civil claim does not wait on the prosecution. Under California Vehicle Code section 20001, a driver who leaves the scene of a crash that injures or kills another person commits a felony punishable by state prison and a fine of one thousand to ten thousand dollars; where the crash causes death or permanent, serious injury, the term runs two, three, or four years. For your recovery, the flight matters less than identifying the driver and every insurer behind them, and where the at-fault driver is never found or carries no insurance, your own uninsured-motorist coverage becomes the case. Because the City of Chino contracts its policing to the San Bernardino County Sheriff’s Department, the collision report and any DUI investigation come through the Sheriff rather than a municipal police department, which changes where we direct records requests and evidence-preservation letters. A collision with a big rig is a different case from a two-car crash: the proof lives with the trucking company and its insurer, not at the scene. The driver’s hours-of-service logs, the electronic logging device data, the maintenance and inspection file, and the carrier’s own safety policies decide fault, and Federal Motor Carrier Safety Administration rules set the standard the carrier was supposed to meet. We send a preservation letter to the motor carrier in the first days of a Chino truck file so those logs and telematics are not overwritten before we can compel them, and we identify every responsible party – driver, motor carrier, broker, and cargo loader – because a serious truck case is rarely against the driver alone.

Third, the trauma-routing question: Chino Valley Medical Center at 5451 Walnut Avenue has a 24/7 ER but is not an American College of Surgeons-verified trauma center – catastrophic-injury patients are transferred to Arrowhead Regional Medical Center in Colton (ACS-verified Level I, approximately 25 minutes east via SR-60 / I-10) or Loma Linda University Medical Center in Loma Linda (ACS-verified Level I, approximately 30 minutes east via SR-60 / I-10, and the only Level I Pediatric trauma center for the four-county Inland Empire region). The medical-billing chronology, the lien negotiation with hospital and physician groups, and the future-medical projection all have to line up across the local-ER plus trauma-transfer records. None of this is impossible for a pro per plaintiff to navigate, but doing it right – and on a schedule that protects the CCP 335.1 two-year statute and the Government Code 911.2 six-month government-claim deadline if a public entity is implicated – is what we do every week.

Compensation in Chino Personal Injury Cases

California recognizes economic damages, non-economic damages, and (in narrow categories) punitive damages in personal injury cases. Economic damages include past and future medical expenses, past and future loss of earnings and earning capacity, household services, and out-of-pocket costs – and on a catastrophic Chino injury where the patient was transferred from Chino Valley Medical Center to Arrowhead Regional Medical Center in Colton or Loma Linda University Medical Center, the medical-expense chronology has to capture both the local ER stabilization and the trauma-center workup, the rehabilitation phase, and the projected lifetime medical needs (typically through a life care plan prepared by a certified life care planner). Non-economic damages cover pain and suffering, emotional distress, loss of enjoyment of life, and disfigurement, all valued by the jury under CACI 3905A without a fixed formula. Punitive damages under California Civil Code 3294 are available only on clear and convincing evidence of malice, oppression, or fraud – typically reached in DUI-fatality and DUI-catastrophic cases (Taylor v. Superior Court (1979) 24 Cal.3d 890). On a Chino wrongful death case under CCP 377.60 and 377.61, the heirs recover loss of financial support, loss of household services, loss of training and guidance to minor children, and loss of love, companionship, comfort, care, assistance, protection, affection, society, moral support, and sexual relations (CACI 3921); the personal representative recovers a separate survival-action component under CCP 377.30 et seq. for the decedent’s pre-death pain and suffering and economic loss. The Chino-specific compensation analysis also has to address Howell v. Hamilton Meats (2011) 52 Cal.4th 541 (the medical-expense reduction rule), Corenbaum v. Lampkin (2013) 215 Cal.App.4th 1308 (future medical-expense calculations), and Bermudez v. Ciolek (2015) 237 Cal.App.4th 1311 (loss-of-earning-capacity even when the plaintiff was unemployed at the time of injury). We coordinate these calculations with an economist, a life care planner, and the treating physicians within the first 90 days of the case so the demand package is supported by expert opinion when it leaves the firm.

California Law That Applies to Chino Personal Injury Cases

Chino personal injury cases are governed by California state law. Negligence is established under CACI 400 et seq. (duty, breach, causation, damages). The default statute of limitations is two years from the date of injury under California Code of Civil Procedure 335.1. If the defendant is a public entity – Caltrans for a roadway-design or signage claim on SR-71, SR-60, or SR-83; the City of Chino for a Public Works signal-timing, sidewalk-defect, or hazardous-condition claim; the County of San Bernardino for a county-road or county-public-property claim – California Government Code 911.2 requires a written claim presented to the public entity within six months of the incident, and the lawsuit must be filed within six months of the public entity’s claim denial under Gov. Code 945.6. Comparative fault is governed by the pure comparative negligence rule from Li v. Yellow Cab (1975) 13 Cal.3d 804 and the joint-and-several economic / several-only non-economic allocation under Civil Code 1431.2 (Prop 51). Premises liability follows Rowland v. Christian (1968) 69 Cal.2d 108 and CACI 1000 et seq. Dog-bite claims are strict-liability under California Civil Code 3342. Wrongful death is governed by CCP 377.60 (heirs) and CCP 377.30 (personal representative survival action). MICRA’s $250,000 non-economic damages cap was raised by AB 35 effective January 1, 2023, with annual increments to $350,000 for non-death cases and $500,000 for wrongful death by 2033 (and equivalent caps that escalate over time). California is an at-fault auto state with a 15/30/5 minimum limits floor that increased to 30/60/15 effective January 1, 2025 under SB 1107 (Dodd, 2022). Uninsured and underinsured motorist (UM/UIM) coverage is regulated under Insurance Code 11580.2 and is included in California auto policies unless rejected in writing. For ridesharing collisions (Uber, Lyft) on Chino arterials, AB 2293 (2014) and the TNC framework require the carrier to maintain $1 million in liability coverage during Period 2 and Period 3 of the trip, plus contingent comprehensive and collision coverage.
